A couple of points;
1.) NSA released this code under the GPL license, which allows  
	distribution, with very few restrictions.

2.) NSA themselves have this "Please Read Our Privacy and Security Notice"
	at the bottom of the page; http://www.nsa.gov which points at this URL;

		http://www.nsa.gov/notice.html

		para. 2 of this page has the following message;

		"Information presented on WWW.NSA.GOV is 
		considered public information and may be distributed 
		or copied. Use of appropriate byline/photo/image 
		credits is requested."

So whatever reasons NSA have in releasing this code to the public, there are 
no reasons why, Ben Johnson, can not mirror, or at least keep a copy of the 
code wherever he wants. 

The only restrictions on this code appears to be the 
"warranty exclusion and limitation of liability" page.

Now they do not have to allow Ben to run mirroring software off of their 
site, if they do not want this. Copying of the code is not an issue, his 
ability to keep the code on his site consistant with the code at the selinux 
site may be.
