The race condition affects kernels _before_ 2.6.30, so no kernels in Ubuntu 10.10. should be affected. It looks like you have found a different problem with firmware download that affects the current compat-wireless but not compat-wireless packaged by Ubuntu. -- Regards, Pavel Roskin
