but in the present form the logic is changing. can you please check the following idea - 

if (driver_info) {
	stats->RxIs40MHzPacket = driver_info->BW;
	if (stats->RxDrvInfoSize != 0)
		TranslateRxSignalStuff819xUsb(skb, stats, driver_info);
}
