Well, I can verify that it doesn't work in 3.9-rc5+ with AR9380 hardware.... I think I'll focus elsewhere for a while..but if someone wants to make this work somehow I'll send them some shiny present :) Even something asymmetric where it encoded in hardware on transmit and software on rx might be useful...
