This patch is not to the kernel, it is to mesa. It has been in mesa for 14 days: http://cgit.freedesktop.org/mesa/mesa/commit/?id=cf0172d46ab940a691da6516057c81f28961482f (Is it necessary to keep talking about already fixed stuff?) I'd say the only reason this is not closed yet is because of the radeon module unloading problems. Thinking of it, I haven't tried in a while..
