It didn't :-( but I tried more on 2.6.9 and found a u32 that works -
tc filter add dev eth0 parent ffff: prio 1 protocol ip u32 match ip
protocol 6 0xff police rate 100kbit burst 10k drop flowid :1
is OK so maybe it is just the fw case that fails.
