The behavior was found in acl-2.2.39-6.el5:
* setfacl -m 'user:test:rw' file
setfacl: /mnt/tests/kernel/filesystems/xfs/xfstests/file: Operation not permitted
* setfacl --version
setfacl 2.2.39
