Do it in the Makefile.  Untested:

ifneq ($(wildcard $(TOPDIR)/include/net/syncppp.h),)
  CFLAGS_driver_name.o += -I $(TOPDIR)/include/net
else
  CFLAGS_driver_name.o += -I $(TOPDIR)/drivers/net/wan
endif

and the driver does #include "syncppp.h".
