How about using a PHY capability override CONFIG.  Something like this:

#if defined(CONFIG_MACB_PHY_CAPAB)    <-- insert better name here
adv = ADVERTISE_CSMA | CONFIG_MACB_PHY_CAPAB;
#else
adv = ADVERTISE_CSMA | ADVERTISE_ALL
#endif
