You are correct. I was reading table 3 (non-specific SRDs) instead
of table 9 (broadband data transmission devices). Table 9 explicitly
requires DFS for 2.4 GHz, 5 GHz, and 6 GHz bands.

Dropping this patch. Sorry for the noise.
