I just found this:

"May 18, 2006 -- Creative plans to make proprietary (closed source)
drivers available for the X-Fi series of sound cards in the second
quarter of 2007. These drivers will have full support for ALSA
(playback, recording, mixer, MIDI, synthesis) and OpenAL 1.1 (with EAX
effects)."
How could this possibly be legal? The alsa-kernel middle layer is GPL!
Maybe they plan to pull an Nvidia and make a GPL wrapper around the same
binary blob they use on Windows? Or maybe this is just BS?

They don't need this.
They can have their own kernel driver and kernel API. Everything other
can be alsa-lib plugin. And alsa-lib is LGPL.

But it would still be a derived work of the kernel. AFAICT the only
legal way is to make a GPL wrapper around their Windows driver like
Nvidia.
