We do not currently support radar detection in ath9k which is required
for these channels. Consequently, hostapd will not allow them to be
enabled. In addition, those passive scanning and no IBSS flags would
also prevent the channel from being used as an AP.

That DFS there indicates the regulatory requirement for detecting radars
and being able to change channels if a radar is present on the selected
channel.

OK, so: how could someone, not from Atheros, write the code to support
radar detection for Ath9k drivers?
Second:
in my case 'dmesg' says that CRDA calls and sets the US country-code,
but then I can't touch it,
with the command 'iw reg set' I'm not able to set the country code
that I want,
what other command, or procedure, should I use instead?

Can you elaborate on this? Keep in mind with atheros devices this
is allowing you to just comply further, you won't enable new channels.
Your best bet is to leave it as is anyway unless you know you shouldn't
be using a channel that your card is already programmed for and you want
to help compliance.
If your card is world roaming you can also just issue a scan to see
what APs are around. If an AP is found those channels will get lifted
the passive scan flag or no-ibss flag -- if, and only if the card is
world roaming.

Please don't retell error messages and don't assume that you are doing
something wrong. Please give exact commands you are using, and explain
how you see that they are not working. Also please tell us where your
wireless-regdb and crda come from. Is CONFIG_WIRELESS_OLD_REGULATORY
enabled in your kernel configuration?

This is by design -- if the card has a regulatory domain set
programmed into it, you won't be able to override it. So its not
that its failing its more that the card already has its regulatory
information properly programmed. This goes for Intel and Atheros wireless
cards. Cards that have no regulatory implementations though can benefit
from user input as there is none -- that accounts for the rest of the cards.
