People this is the second time I'm asking with no one response.  ath9k_htc
failed to get compiled on a Linux kernel 3.0.36,  any reason why?

With so match information probably no one filling to have jeday power.
I assume you mean this message:

If yes, then answer is clear:

Do you trying to port new ath9k source to old kernel? Did you tried 
wireless backports? It makes no sense to report bug of really old kernel.
