Ok, after a bit more investigation, the -EINVAL seems to be coming
from acpi_processor_preregister_performance()
Should ..
                if (!performance || !performance[i]) {
                        retval = -EINVAL;
                        continue;
                }

be -ENODEV perhaps ?
