The problem is that kernel 2.4 is still on release 2.4.31, far from 2.4.4.

 2.4.4 kernel or ABOVE that means 2.4.5 , 2.4.6 ....... 2.4.31 ........

Is that  A PROBLEM?

I guess it means a kernel 2.4.4 or superior! (2.4.5, 2.4.6 and so on).
