IIRC there can't be an mp3 encoder that is free software because of patent
problems; I seem to have heard of recent changes in the patent ownership but
I don't think that the situation has changed. So if we want a free mp3
encoder, we will have to either convince the patent holders that this is
okay, or design a replacement format that we can use with free software
(this is actually an item on the GNU Task List, but I don't think that
anyone is working on it yet).

I like blade encoder. Its not open source, but its free. Its fast, and
from what I can tell makes a good encode. Its a huge improvement over
l3enc 2.72 which I was using b4 blade. I believe you should be able to
find it at www.linuxberg.com

There IS an free mp3 player for linux!!!!
It´s called FREEAMP!!
I use it!!!
It´s on the SuSE 6.1 cds!!

Not entirely true. Bladeenc is going to be released with source[1] if and
when some patent issues are dealt with. These patent issues are very
strange. Apparently software can't be patented is Sweden, but the mp3 guys
have a software patent in Sweden. Look at the bladeenc site
http://www.bladeenc.cjb.net for more details.

[1] apparently it will not be LGPLed as the author originally intended due
to the patent

Do you know when this might happen, and if the source code will be open
source/free software when it is released? Unless I missed it, the Bladeenc
site doesn't seem to mention anything about this.

Wrong. There are countries where they (rightly) do not recognize patents
on algorithms. One of the free mp3 encoders was written there, where
Fraunhofer cannot touch them.

Apparently it's just waiting on the patent issues. The source will be
available under a Free license (although I think the reason he can't do 
GPL or LGPL is because of patents). Read the site I mentioned for more
details. Under news in the bladeenc section. It's a long section.

As I understand it, if patents are not filed within the countries which
code the mp3 codecs, then there are no patents to recognise !
Often this would be countries which will result in sales which are to few
to warrent the cost of the patenting process.

Well, the problem is that most of the mp3 players aren't distributed as
source, thus if you have odd hardware (I have MOSTLY odd hardware) they
won't run. I use mpg123 myself.
